1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of TBest-Jobs.com (“TBest Jobs,” “we,” “us,” “our,” or “the Platform”), including any services, features, job postings, resumes, applications, employer profiles, and paid subscriptions available through the Platform.

By creating an account, purchasing a package, or accessing any portion of the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Description of Services

TBest Jobs is an online employment marketplace that provides:

  • Job posting tools for employers

  • Employer profile management

  • Resume hosting and resume builder tools for job seekers

  • Subscription-based resume database access

  • Communication tools between job seekers and employers

We may update, modify, or discontinue any part of the Platform at any time without prior notice.

3. User Accounts

3.1 Eligibility

You must:

  • Be at least 18 years old

  • Have legal capacity to enter these Terms

  • Use the Platform only for lawful purposes

3.2 Account Registration

Users must provide accurate, complete information.
You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • All activities under your account

We may suspend or terminate accounts for inaccurate information, policy violations, or suspicious activity.

4. Job Seekers

4.1 Resume Creation & Visibility

Job seekers may:

  • Upload a resume or create one using our resume builder

  • Choose public or private visibility

  • Edit or delete their resume at any time

Public Resume (Limited View)

Your name, phone number, and email remain hidden from public view.
Only verified employers with an active subscription may access full contact details.

Private Resume

Visible only to:

  • Employers you apply to

  • Employers you explicitly grant access

4.2 Job Applications

When you apply to a job, your full resume and contact details are shared with that employer.

4.3 Responsibility

You are solely responsible for:

  • Accuracy of your resume and profile information

  • Content you upload or publish

5. Employers

5.1 Employer Accounts & Verification

Employer accounts must reflect the real company and real hiring contact.
We may require verification before granting access to resume databases.

5.2 Use of Candidate Information

Employers must:

  • Use candidate data solely for legitimate hiring purposes

  • Not share, resell, distribute, or misuse candidate information

  • Not contact candidates for marketing, promotions, or unrelated purposes

  • Not discriminate in hiring practices

Violation of these terms may result in immediate suspension, termination, and reporting to appropriate authorities.

5.3 Job Posting Standards

Employers agree that postings:

  • Must be accurate and lawful

  • Must not contain misleading or fraudulent information

  • Must not involve pyramid schemes, spam, or non-employment offers

  • Must comply with all applicable federal, state, and local employment laws

We may remove any posting at our discretion.

6. Payments, Subscriptions, and Billing

6.1 Employer Packages

Employers may purchase paid packages that include:

  • Job postings

  • Resume database access

  • Employer branding features

Package features are described at the time of purchase.

6.2 Automatic Renewal

Some subscriptions renew automatically unless canceled before the renewal date.

6.3 Payment Processing

Payments are processed through secure third-party providers.
We do not store complete credit card details.

6.4 Refunds

Refunds are governed by our Refund & Returns Policy.

7. Prohibited Activities

All users agree not to:

  • Scrape, harvest, or extract data from the Platform

  • Attempt unauthorized access or interfere with the Platform

  • Post unlawful, harmful, or discriminatory content

  • Misrepresent identity or company affiliation

  • Upload malicious code or engage in fraudulent activity

  • Use another user’s account without authorization

Employers specifically agree not to:

  • Mine resumes for marketing databases

  • Share candidate data with third parties

  • Post fake jobs or misleading opportunities

8. Intellectual Property

All content, branding, layout, design, code, and materials on the Platform belong to TBest Services Inc. or its licensors.

User Content

You retain ownership of content you upload (resumes, job postings, profiles).
However, by uploading, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content as necessary to operate the Platform.

9. Employer Profile Claiming

Employers may request to claim a company profile that appears in listings.

By claiming a profile, you represent that you are authorized to act on behalf of that company.

TBest Jobs reserves the right to verify authorization or deny a claim request.

10. Third-Party Services

The Platform may integrate with:

  • Analytics providers

  • Payment processors

  • Applicant tracking systems

  • Email communication tools

We are not responsible for third-party actions or policies.

11. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, including:

  • Accuracy of job postings

  • Availability of applicants or employers

  • Employment outcomes

  • Error-free or uninterrupted service

Use the Platform at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law:

TBest Services Inc. is not liable for:

  • Lost profits, revenue, or business opportunity

  • Loss of data

  • Hiring decisions or employment outcomes

  • Damages arising from employer misuse of candidate data

  • Service interruptions or errors

Maximum liability in all cases is limited to the amount paid by the user in the past 12 months, if any.

13. Indemnification

You agree to indemnify and hold harmless TBest Services Inc. from claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the Platform

  • Your violation of these Terms

  • Your infringement of third-party rights

14. Termination

We may suspend or terminate any account at any time for:

  • Violations of these Terms

  • Fraud or suspicious activity

  • Misuse of data

  • Non-payment

  • Platform abuse

Users may close their accounts at any time.

Certain obligations (e.g., payment, indemnification, misuse of resume data) continue after termination.

15. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles.

Any disputes must be resolved in state or federal courts located in Maryland.

16. Changes to the Terms

We may update or modify these Terms at any time.
Changes take effect when posted on the Platform.

Continued use of the Platform constitutes acceptance of updated Terms.
